910-23 and Race
According to the results from the 2007 National Survey on Drug Use and Health conducted by the Substance Abuse and Mental Health Services Administration, "Current illicit drug use...rates were 9.5 percent for blacks and 8.2 percent for whites".
Despite the fact that drug use rates among blacks and whites are similar, and despite the fact that blacks make up less than half of the population of Cincinnati, almost 90% of those ticketed under the Ohio law and more than 85% of those arrested under 910-23 were black.
